naturalization self test

92% pass

notes on discrim

heterogenous-mix of different things
society-composed of different people or cultures
immigrant- a legal citizen from a different country
reservation-public land given to the native americans by us government
refugee-a person who moves to another country for their protection
assimilation-adapting to the majority's life style or culture
us population is prominently white, african, hispanic, and asian have grown most
more females than males
african americans have suffered longest
african americans are 14% of population
Native Americans were originally 1 million, we cut them down to 250,000
today they are 6 million'

hispanics are the largest majority, 50 million
4 subgroups, mexican americans, puerto ricans, cubans, and central and south americans
asian americans-chinese laborers were first asians to come to america
1850-60s often faced violence
chinese exclusion act of 1882-80 years
ww2- all japanese were evacuated to pacific coast even natives
congress-changed their ways

civil rights cant change morality by passing a law
Dr. King "judicial dexrees... may not change the heart, bu can restrain the heartless"
1870-1950s - no meaningful legislation passed for civil rights
civil rights act of 1964:longest debate in senate history, 83 days
Civil rights acts of 1968-aka "open housing act"-cannpt refuse selling/rent living space to a person due to race, religion, national origin, physical disability, etc. Housing is still one of the most segregated areas in American life today
Title IX: forbids discrimination on the basis of gender in any educational program or program regarding financial assistance equal funding and opportunities must be given to woman athletes

AFFIRMATIVE ACTION:
requires employers take positive steps to fix the effects of past discrimination
employers must meet quotas for minority groups/genders

many argue this results in reverse discrimination: discrimination against the majority group; they are denied opportunities so minority groups more opportunities
"color blind"
California, Washington, Michigan, and Nebraska voters passed measures to eliminate all affirmative action plans
The bakke case:
allan bakke sued the uni of cal b/c he was denied access to their medical school due to affirmative action (16/100 seats were reserved for minority students)
since then, the court has made decisions regarding similar cases, quotas can be used when needed
Justice Sandra Day O'connor predicts in 25 years, the use of racial pref will no longer be necessary

an american citizen=person swears allegiance to us and entitled to protection and priveleges of its laws
beefore 1860s citizenship was not important to pepople living in us, immigration all time high
14th amendment was the first constitutional definition-
-"all persons born or naturalized in the us and subject to the jurisdiction thereof, are citizens of the us and of the state wherein they reside"
constitution declares that a person becomes an american citizen one of two ways: by birth or naturalization
90% of americans are citizens by birth
naturalization is the legal process by which person becomes citizen, CONGRESS HAS EXCLUSIVE power to provide naturalization
normally naturalization is individual, collective naturalization is entire groups are granted citizenship through a treaty or act
loss of citizenship- every citizen has the right to voluntarily abandon citizenship, called expatriation
congress cannot take away citizenship, even if you are involved in another country's affairs.
naturalized citizens can lose their citizenship through denaturalization, only occurs by a court order because of fraud or deception
marriage does not make a person a citizen, only shortens time of the naturalization process

congress has the exclusive power to regulate the crossing of this nation's borders: inward and outward
quotas for immigration began to exist: limits to the number of people allowed from each country/territory
immigration act of 1965 did away with the quota system- up to 270,000 immigrants are allowed into the us each year-preference given to immediate family of current american citizens

immigration act of 1990 governs the admission of aliens into the us, this act now allowed 675000 immigrants into the us each year, special preferences still given to immediate family members of american citizens and those with occupational talents are also given special preference

some people are denied entrance based on their characteristics: criminals, mentally ill who might be a harm to others, etc.
deportation is the legal process by which aliens are required to leave the country. alien does not distinguish between legal and illegal.
biggest reasons for deportation are illegal immigrant and conviction of a serious crime

Picture Project

What is happening in this picture?
These Latin Americans are on their way to a job at Home Depot. They are being discriminated against because that is the stereotypical place for them to work. The one man is even hiding his face from the camera. The camera man is discriminating against them and making fun of them.

What's going on in America during this time?
America has stereotyped Latin Americans into being illegal immigrants, even when many are not. They are grouped together as a bunch of lazy border jumpers. The camera man is clearly trying to make a joke out of the fact that they are Latino and on their way to work at Home Depot.

What do the people's faces reflect?
They are dissatisfied with the camera man as they are just trying to get to their job.

Give an example of how this might happen today.
Although this is relatively recent, racism towards latin americans has died down as the millennial decade has come to an end. That doesn't stop this sort of thing from happening on a regular occasion, though. Each day people see Latin Americans doing their job and immediately begin to make judgments about their work ethic or their legitimacy as a United States Citizen.

Cameras should most definitely be a required installment in automobiles. Due to the progression of technology and the advancement of the world, society is at a pivotal point that can be used to reduce the amount of car fatalities with little effort. The addition of a monitored driving experience will monitor drivers that make reckless decisions as well as find what is the proper handling of a situation that may be unclear. Keeping the cameras faced forward and muted is an easy way to withhold the rights of the citizens.

3-31-14

To put things into perspective, the human condition can be described as being composed of three general emotions: lust, envy, and greed. When some of these natural instincts are combined, they produce a natural hatred and slanderous feeling towards one another, simply out of ignorance of the situation or preference of personal gain over character. This is just the case when it comes to something as ancient yet currently prevalent as racism. Although it is easy to say that it has improved over time through the strife of heroes alike Martin Luther King Jr., Gandhi, and Malcom X, the nature will continue to persist in the human instinct in another way, shape, or form. Whether it's racism, gender bias, or some other form of bigotry, people will never quit being the scum that we cannot help but be.

Notes for 3/27/14

Military court must have 2/3 majority insetad of unanimous
court of appeals has the jury made up by civilians
Military commissions were created by G.W. Bush in 2001.
these courts try suspected terrorists
in 2006 the supreme court ruled military commissions improperly established
Obama recently closed Guantanamo Bay

Court of federal claims, the US can only be taken to court with its permission

D.C. courts is the judicial system for nation's capital
congress has established two state like courts: a superior court and a lower court

United States Tax court is independent in the legislative court

3-27-14

I would have to say that I'm not well-versed enough in this area to accurately answer this question. The current situation seems to work out well. I can't say that it would be much better if the judges in the supreme court were elected by the general public. I do not think that it would turn out quite as well, even though that may seem like the more democratic thing to do.

Supreme Court Cases

1. Religion-

  • Pleasant Grove City v. Summum
    • A municipality that allows a privately donated Ten Commandments monument to be displayed on public property need not permit the religion of Summum to put up its own statue of similar size.

2. Minority-

  • League of United Latin American Citizens v. Perry
    • Texas's 2003 redistricting of District 23 constituted a violation of Latinos' rights under the Voting Rights Act of 1965; mid-decade redistricting is constitutional as long as it is not solely motivated by partisan gain

3. School system-

  • Davenport v. Washington Education Association
    • A state may require that its public-sector unions receive authorization from nonmembers before spending their agency fees for election-related purposes

3-20-14

I believe in judicial activism. The original intent of the constitution cannot be applied to things that were completely out of comprehension before (such as the internet).

Lecture notes Section 2

Inferior Courts:
created to function beneath supreme court
Disctrict courts: 677 judges handle more than 350,000 cases per year- 80% of federal caseload.

alien terrorist remove court decide whether those identified as alien terrorists by us attorney general should be expelled from the country

district courts do not hear cases within original jurisdiction of supreme court, both criminal and civil, criminal case the us is always the prosecutor. in a civil ase the us can either be the plaintiff or the defendant

most decisions in fed district courts are final, cases start and end there. few of the cases go higher

Courts of appeals were created by congress to relieve supreme court of hearing all appealed cases
each court has 6-28 judges and 1 supreme court justice assigned to each district
normally 3 judge panels

which example of the check on congressional power to set their paychecks is this?

they weren't doing their jobs, that's why they weren't being checked.

Would you sign this petition why or why not?

yes, because they already get a ton of money, and taxpayers are pAYING THEM TO SIT AROUND AND DO NOTHING.

2-4-14

does this story show a breach in first amendment rights?

yes, it isn't defamation at all, it is expressing an opinion

what can your congressmen do about this?

add a clause to the law about defamation of character excluding reviews or critique of an establishment or service.

2-7-14 make a law about anything

I would make a law requiring every member of congress to pass a series of tests on current issues and technological standards.

WAR

1. I think that the recent boost in revenue in Colorado from the legalization of marijuana is a great way to make money. It's shown to have almost no consequences of its legalization and simply taxing it at 100% would most certainly put some money on the table. On top of that, we could always create war bonds.

2. I think that we could easily create an all-volunteer force. Our school hates them enough anyways, they'd be happy to go to war with them.

3. I think that since we are staying in the United States, instead of mail we should just manage a partnership with U.S. cellular so that all soldiers receive a free new phone, a buy out from their previous contract, and a reduced price on their contract.

4. I say that we make a deal with Buchannon. We aren't losing anything, we're gaining a little bit of land from Taylor County.

To be honest, I'm not even surprised about this sort of criticism of West Virginia. I'm used to the standard that we are held to, and although there are very many exceptions to this stereotype, the opinion of West Virginia probably will not change for some time.
